Thank you for choosing ExclusiveFlyer.
ExclusiveFlyer is a website that offers you a huge diversity of flyer, brochure templates and other content (further items) for free or via subscription.
When we say ‘we’, ‘us’ it is related to ExclusiveFlyer (Viktor Sologub, exclusiveflyer@gmail.com) as an owner of the website and all content published on it.
When you create an ExclusiveFlyer account and accept these Terms and conditions you are entering into an agreement with ExclusiveFlyer. Please read and understand this Terms and conditions. If you don’t accept this Terms and conditions please don’t use ExclusiveFlyer website and don’t buy any items, subscription or related services.
The items on ExclusiveFlyer are owned by ExclusiveFlyer, it licensors or authors. They are licensed to you under the terms of the File license.
Subscription rules
When you buy a subscription (monthly or yearly) you get an unlimited access to a collection that must be used in accordance with the terms of the File license.
Only real people, using their real details, can subscribe to ExclusiveFlyer.
You need to be 18 years or over to become a subscriber.
You promise that information you give us is true, accurate and complete and that you will keep your account information up-to-date (including a current email address). Your subscription is not transferable. You are responsible for any use of ExclusiveFlyer that occurs in conjunction with your username and password so keep your password secure and don’t let any other person use your username or password. If you realise there’s any unauthorized use of your password or any breach of security you need to let us know immediately.
When you download an item as a subscriber, you will be granted a license from us to use that item. By downloading an item you’re not actually acquiring ownership of the item itself, only the license to use that item. Items are subject to specific terms of use, and these terms are set out in the File license.
Payment for subscription
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
You can pay for your subscription via PayPal, credit card or other specified payment methods. You may be required to pay a handling fee depending on the method of payment you choose.
Pay attention that all our subscriptions have auto-renewal. It means that after the expiration of your subscription – it will automatically continue. To turn off the auto-renewal of subscription you need to contact our support and give your information (Sales id number and Order id number).
You are responsible for all costs of currency conversion relating to your ExclusiveFlyer subscription. Your financial institution does the currency conversion and may charge you additional fees (we don’t control either the conversion rates or your financial institution’s fees).
This means that you may incur additional costs when subscribing to ExclusiveFlyer, which we have no control over.
When you subscribe to EXCLUSIVEFLYER, you do so on the following terms:

- you promise to us that you understand what you can and can’t do with your downloaded items in accordance with the File license;
- once you downloaded the item, you acquire a non- exclusive license to use the item under the terms set out in the File license (non-exclusive means others might also license the same item); and
- you do not gain any ownership rights in a downloaded item.
It is important that you understand the terms on which you are making a purchase. Please take the time to review this section carefully.
The final prices and fees are inclusive of transactional taxes where relevant (like VAT). You are responsible for paying all other fees and taxes associated with your use of ExclusiveFlyer wherever levied.
Refunds and cancelations
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
All the products from ExclusiveFlyer have absolutely exclusive design and they were created for saving time as an inexpensive alternative to get printed promotional materials.
If you understand that you have bought the wrong template after your purchase, and this template can’t suit your needs, please contact us to our support or to our e-mail exclusiveflyer@gmail.com to change a product or to make a Refund. We are committed to make a refund within 2 business day after the purchase of our template but sometimes it may take a longer period of time.
If you have bought our subscription and now understand that it isn’t suitable for you – there are 3 days to make a cancellation and ask for money refund.
Intellectual Property
We own all the ExclusiveFlyer content and items that we have put on ExclusiveFlyer (unless otherwise stated and excluding content owned by others). This includes the design, compilation, and look and feel of the ExclusiveFlyer site, and copyright, trademarks, designs and other intellectual property on ExclusiveFlyer. We own all the trademarks, logos, service marks and trade names on ExclusiveFlyer (unless otherwise stated and excluding these things owned by others). You will not copy, distribute, modify or make derivative works of any of our ExclusiveFlyer or use any of our intellectual property in any way not expressly stated in these terms.
We do not own some of the items that are owned by our licensors or authors. However, we have the right to sublicense the items to you on the terms of the File license.
We respect your privacy and process your information in accordance with our Privacy Policy.
Being a subscriber is not an automatic right, it is a benefit for those who follow our reasonable rules. We hope that you will be with us for a long time. But we may, using reasonable discretion, decide whether or not your use of ExclusiveFlyer complies with these Terms and conditions. We can suspend or terminate your subscription account at any time for any reason (acting reasonably of course) including: if you breach these terms or if you act in a way that could cause us or others harm.
We may use the services of another company to collect payment or carry out other activities with you to bring you ExclusiveFlyer services.
Liability and indemnity – between us and subscribers
You indemnify us against all losses, costs (including legal costs on a full indemnity basis), expenses, demands or liability that we incur arising out of, or in connection with, a third party claim against us relating to use of ExclusiveFlyer, any item or the products or services forming part of any Third Party Offer.
ExclusiveFlyer, the items and all possible third-party offers are made available to you on an “AS IS” basis. We disclaim all warranties, express or implied, including any implied warranties of non-infringement, merchantability and fitness for a particular purpose.
Our liability to you in connection with ExclusiveFlyer or these Terms and conditions, in contract, tort (including negligence) or otherwise, is limited as follows:
- we exclude liability for any of these things incurred by you: loss of revenue, loss of profit, loss of goodwill, loss of customers, loss of capital, damage to reputation, loss in connection with any other contract, loss of data, or indirect, consequential or special loss, damage or expense; and
- our total aggregate liability to you is otherwise limited to the total amounts paid by you to us for your ExclusiveFlyer subscription in the 6 months immediately preceding the date on which the claim giving rise to the liability arose.
Other provisions
We may block you, terminate your subscription or refuse to process a payment if we reasonably believe there is a risk associated with you, your subscription, or that payment, including if it breaches a law or regulation.
Nothing in these terms is to be construed as constituting a partnership, joint venture, employment or agency relationship between you and us, or between you and any other member. Neither you nor us can bind each other in any way.
Any notice you send us must be submitted to support email. Any notice we send to you will be emailed to the email address you provided to us.
We may change these terms at any time. If you continue to use ExclusiveFlyer the changes are made, then you will be agreeing to the changes regardless of the amount of time which has elapsed.
We control and operate ExclusiveFlyer from our office in Ukraine. The laws of Ukraine govern these terms, and you submit to the jurisdiction of the courts of Ukraine there for the resolution of any dispute between us.
